House Policies appear in italics.

The text appearing in ????? are considered annotations. They are not part of the actual Bylaws but rather a supplimentary explanation. Due to the fact that the typical length of membership is between 1-3 years, events far in the past are almost all but forgotton. One consequence of this fact is that a Bylaw constructed by one generation will become viewed as pointless by a subsequent generation. It is our hope that these annotations will provide future generations the necessary wisdom to understand these Bylaws.
  1. Member Rules
    1. Members must perform workshifts and do other duties as described in the Workshift Bylaws. (See Workshift) *
    2. Members may not allow their cigarette smoke to enter indoor common spaces. *
      • If at a party you toked and smoked,
        no punishment shall be invoked.
    3. Members may not leave messes in common spaces. **
      It's ridiculous to assert that members who flagrantly leave messes around the house are honoring their cooperative obligations.
      • A mess you left: the pots, the slop, the oil in which you fried,
        fine by me, one workshift hour should keep you occupied.
    4. Members must have official residential contracts with the USCA. All persons without official residential contracts are non-members. *
    5. Members must accompany (host) their guests (non-members) when they are in common spaces. Members are directly responsible for the all actions of their guests.
    6. Members must make sure that unaccompanied non-members (i.e. sketchers) are not in common spaces.
    7. Members may not keep common house property (i.e. couches, foosball table, etc.) in private rooms without explicit Council approval.
      • A house couch in your room? You poo!
        $200 fine for you!
    8. Members may not keep personal belongings that are not job-related in house facilities (i.e. closets, maintenance room) without explicit Council approval.
    9. Members may not withhold house-related information or put undue restrictions on any common facility unless it harms the general welfare of the house or threatens personal privacy. **
    10. Members must pay a key fee upon the loss or non-return of keys.
      • Losing your room key, it's no big sweat,
        cough up 5 dollars and it's all set,
        but lose a gate key, that really sucks,
        do it and prepare to pay 30 bucks!
    11. Members must pay all fees and fines before the end of each of fining period or be charged a penalty. The Minister of the Treasury Manager will post all fees, fines, and fining period dates, but members are responsible for payment even if the Minister of the Treasury Manager is delinquent.
    12. Members may not enter a private room without authorization unless it is a life threatening emergency. Exceptions to this rule apply only to the The Czar and Czar of Controlled Decay, who may enter a private room if 24 hours notice is given and only for reasons explicitly given in their duties.
    13. Members may not steal, destroy, harass, threaten, etc. If this isn't completely obvious, you shouldn't be living here.
  2. Boarder Rules
    1. Boarders must comply with member rules, yadayadayada...
    2. "Central-level boarders" have signed contracts with C.O. "House-level boarders" have signed contracts with Casa Zimbabwe.
    3. Each semester, boarders must first be approved by 1/2 majority vote in Council. Boarders can be dismissed by 1/2 majority vote in Council.
    4. Boarders must perform two hours of workshift per week or pay an additional fee.
    5. (Insert house policy about paying $125 per month and $80 if you don't do workshifts here)
    6. Boarders may obtain a gate key by paying a key deposit. The deposit is the same as the member fee for losing a gate key.
    7. Boarders have the right to participate and vote at Council.
  3. Workshift
    1. Members are required to complete 5 hours (3 during Summer) of regular workshifts per week under contract. In addition, members must complete periodic bathroom and hallway cleaning workshifts.
      • The Czar of Labour may reduce requirements during extended school vacations and/or finals.
      • Hours are assigned by the Czar of Labour.
    2. All members who live in the house for 4 weeks or more are required to complete 5 (3 during Summer) Home Improvement (HI) workshift hours per semester.
      • During Fall and Spring, at least 3 HI hours must be completed before week 6, or the date of the FUCK party, whichever is sooner. The remaining 2 HI hours must be completed before week 11. (See FUCK)
      • During Summer, all 3 HI hours must be completed before week 6.
      • Hours are assigned by the Director of Expressive Dynamism.
    3. Members are responsible for completing their required hours, regardless of the delinquency of other members in assigning them.
    4. Members must provide written evidence (i.e. workshift signoff, timecard) to the Czar of Labour for all workshift hours performed. However, workshift hours granted automatically for elected positions do not require written evidence. (Members in elected positions are accountable via election process, Council, the VOC and recall petitions.)
    5. Every assigned hour (including bathroom, HI, etc.) not completed on time is converted to at least one owed regular workshift hour. The exact number is at the Czar of Labour's discretion.
    6. At the end of each fining period, each member is fined the Central Office workshift rate for every owed hour. If 10 (8 during Summer) or more hours are owed, the fines for all owed hours are doubled.
    7. If a member owes 15 (12 during Summer) or more workshift hours for 7 consecutive days, the Czar of Labour must initiate a workshift termination grievance against that member.
    8. The Czar of Labour has the option to use money generated from workshift fines to pay members to do workshifts. The following conditions apply:
      • The Czar of Labour must notify the membership at least 24 hours in advance of any paid workshifts.
      • Paid workshifts must be available to all members.
      • The Czar of Labour must fairly assign paid workshifts.
      • The Central Office workshift rate must be used for all paid workshifts.
      • No other type of credit (i.e. workshift hours) may be granted in addition to monetary compensation.
  4. Grievances and Contestations
    1. Cooperation

      Casa Zimbabwe cannot function well if its members never express their feelings to each other. While it may be intimidating or scary to confront anybody, you'll find that most people are actually quite reasonable. It is important to speak up when you feel that somebody is doing something wrong. When nobody challenges obnoxious behavior, that behavior will eventually become acceptable.

      If it is too difficult to talk directly to the person that's bothering you, have the House Manager or other member talk to the person for you. If your concerned about somebody's job performance, try talking to their respective manager or the Commissar. You always have options, and by default, your anonymity will be respected.

      While cooperation is the best way to solve such problems, it is not always possible. People can become defensive, rude or just downright nasty when they're confronted. At other times, people will do things that are completely unacceptable. The grievance procedure exists when attempts at cooperation are unsuccessful or impossible.

    2. Rights and Rules
      1. Members have the right to file grievances. The filer of a grievance may withdraw the grievance at any time. **
      2. Members who issue grievances are to be treated anonymously unless they explicitly request otherwise. Violating anonymity is considered a serious offense.
      3. Members may not file frivolous or excessive grievances. The right to anonymity may be voided in extreme cases. **
      4. CO sponsored moderation is recommended and available on request for any interpersonal conflicts.
      5. Members have the right to challenge the work performance of any member, with or without an elected position, via the Grievance Procedure. Recourses may include compensation reduction (when applicable), fines, additional workshift hours, workshift position change (when applicable) and recall (when applicable).
    3. Grievance Procedure

      All steps in the Grievance Procedure must be followed expediently and responsibly.

      1. If you wish to remain anonymous, issue a grievance against the individual by informing the House Manager or any trusted member. Be sure to include the all details of the situation and, using the House Policies as a guide, what you think the appropriate recourse should be. The The Czar or trusted member will then carry out the grievance on your behalf.
      2. If you wish to carry out the grievance by yourself, or you are handling the grievance on behalf of somebody else, then inform the individual of the situation. If s/he contests the grievance, inform the Commissar to add the grievance motion to the agenda. If s/he does not contest the grievance, then the appropriate persons must be informed to handle any penalties (i.e. Workshift Manager, Minister of the Treasury Manager). Grievances recommending member termination, probationary contract or PNG are automatically contested and must be brought to Council.
    4. Contestation Procedure

      All steps in the Contestation Procedure must be followed expediently and responsibly.

      1. If somebody brings a grievance against you that you feel is unjust, try to work out the situation by talking to him/her. If that fails or if the original filer of the grievance chooses to be anonymous, bring the issue to Council. The person who brought the grievance against you will add the grievance motion to the next Council agenda.
      2. If the Commissar contests any grievance filed against him or her but fails to add the motion to the next Council agenda, the Commissar is immediately recalled. (This is to prevent the Commissar from dismissing grievances filed against him or her.)
      3. Council will discuss the case and determine what recourse, if any, is appropriate for the situation. If you feel the decision made by Council was unjust, you can appeal to the USCA Administrative Committee.
  5. Motions and Voting
    1. All motions must be approved through Council unless it is otherwise explicitly stated in the Constitution or Bylaws. House-wide ballots or petitions are only valid when they are explicitly allowed by the Constitution or Bylaws.
    2. Votes on all motions must have an "abstain" option available. A vote of abstention means that the member, for whatever reason, chooses to make no decision regarding the motion.
    3. Negligence, malice or tampering with the voting process is a serious offense.
    4. All written ballots must be kept confidential and anonymous.
    5. Members may not vote on motions they are collecting or tallying.
    6. 1/2 majority is achieved when more than half of the votes excluding abstentions are in favor of the motion.
    7. 2/3 majority is achieved when more than two-thirds of the votes excluding abstentions are in favor of the motion.
    8. All house-wide votes are organized by the Commissar and must be open for 2 days, no more, no less.
    9. All house-wide votes require at least 2/3 of all members to vote. House-wide votes that do not meet this requirement are considered void.
    10. Motions that levy member fees (i.e. social fee, ISP fee) require 2/3 majority and no more than 1/5 abstentions in a house-wide vote to pass. Motions that levy member fees may only levy member fees.
  6. Council
    1. Organization
      1. For any body X, X is a governing body of CZ if and only if X is identical to Council. **
      2. Quorum is 20% of all members. **
      3. A petition of 20% of all members may call Council with 24 hours notice. **
      4. Council must be held once a week, excluding holidays and UC Berkeley finals. Weekly Councils are organized by the Commissar.
      5. There must be a secretary to record minutes at Council.
    2. Rights and Rules
      1. Members have the right to participate in Council. **
      2. All motions must be proposed by one, and only one member. That member has the right to drop, alter or table the motion at any time before voting.
      3. Members unable to attend Council may vote on any motion by proxy prior to Council.
      4. Any member may request that a vote be taken by a secret ballot.
      5. Members may not filibuster, stall, flood the agenda, or otherwise prevent an issue from being fairly considered. **
      6. Members may not propose motions during discussion that do nothing or otherwise keep the status quo. (Members should vote against proposed motions, not bring up new motions that don't do anything in order to confuse the process.) **
      7. Members may not propose motions during discussion that are off-topic. (Such motions should be added to the agenda once the current discussion and voting are over.) **
    3. Motions
      1. Motions require the largest voting requirement of any item contained in it.
      2. All motions, unless otherwise noted, require 1/2 majority to pass.
      3. Motions that contain any of the following require 2/3 majority to pass:
        • House expenditures
        • Member fines over $100
        • Alteration of VOCs
        • Party approval
      4. Motions that contain any of the following require 2/3 majority in two consecutive Councils to pass:
        • Bylaw amendment **
        • Reimbursements for expenditures made without prior Council approval. Exceptions are made for expenditures necessary to meet habitability code -- they only require one 2/3 majority vote to pass.
        • Member termination
        • Probationary contract
        • Change in PNG status
    4. Facilitator
      1. Council is run by a Facilitator who is appointed by consensus of members at the start of the meeting. If Council cannot unanimously agree on a Facilitator, or nobody cares, then the chain of command is as follows: Commissar, Board Representative, Minister of the Treasury Manager, The Czar, Drug Czar, House Bitch (a gender neutral position). If no House Bitch is available, Council is disbanded. Members shall instead shout chants of, "Death to Krackistan! Death to Krackistan! Long Live Krackistan!"
      2. The Facilitator may, at any time, stand down and appoint a replacement for any particular discussion or motion.
      3. The Facilitator must be neutral and impartial to all members and issues -- there must not be a conflict of interest between the Facilitator and the topic at hand. If there is a conflict of interest, or the Facilitator wishes to speak or vote on any motion, the Facilitator must stand down.
      4. The Facilitator tallies votes in Council.
    5. Voting Procedure
      1. If only one motion is present at the end of discussion, the Facilitator conducts a vote on the motion with "approve", "reject" and "abstain" options. If abstentions count for more than 1/5 of all votes, then the vote is suspended and the motion is rediscussed and revoted. The motion passes if it meets its minimum voting requirements.
      2. If there are multiple proposed motions during discussion, members who have proposed motions should make every effort to compromise and alter or drop their motions so that as few motions remain. The Facilitator should conduct straw polls and make impartial recommendations in order to achieve this effect.
      3. If multiple motions remain at the end of discussion, the first motion (chronologically) is voted on individually via procedure A. If this motion succeeds then all the remaining motions proposed during discussion are dropped. If this motion fails, then the second motion is voted on individually via procedure A and so on.
  7. Elections
    1. Elections shall be initiated and organized by the Commissar.
    2. General elections for Summer and Fall are held in the previous Spring. General elections for Spring are held in the previous Fall.
    3. All available positions and their job descriptions must be posted by the Commissar at least one week before any election.
    4. Members have the right to run for any elected position. **
    5. Elections are decided by house-wide written ballot. The Commissar must organize another election if not enough members vote.
    6. The Commissar can appoint up to two trusted members that are not candidates in the elections to distribute, collect, and tally ballots. They may each be compensated up to 2 workshift hours.
    7. For each position, the candidate with the most votes wins. In the case of a tie, a run-off vote is taken. If abstentions constitute more than 1/5 of the votes for a position, then no candidate for that position wins and a new election is held for that position.
  8. Votes of Confidence
    1. The Votes of Confidence (VOC) shall be initiated and organized by the Commissar.
    2. During Fall and Spring, the VOC shall be held once during week 6 and once during week 11. During Summer, the VOC shall be held once during week 6.
    3. The Commissar is automatically recalled if any VOC is not organized on time.
    4. The VOC is conducted by house-wide written ballot. The Commissar must organize a new VOC if not enough members vote.
    5. The Commissar shall appoint up to two trusted members that are not being evaluated in the VOC to distribute, collect, and tally ballots. They may each be compensated up to 2 workshift hours.
    6. Jointly-held positions are treated as a single position. Members are responsible for the negligence of their partners.
    7. The VOC ballot can be altered with a 2/3 majority council vote.
    8. The VOC ballot is part of the Bylaws. The distributed ballot must not have any significant deviations from the ballot listed in the Bylaws.
    9. For each question on the ballot, if "no" votes meet or exceed "yes" votes, or if abstentions constitute more than 1/3 of the total, the position responsible for it becomes disputed.
    10. Any member with a disputed position must address Council and obtain a reaffirmation vote by the first Council following the VOC results. If s/he fails to do so, s/he is automatically recalled and new elections are held for that position.
    11. Reaffirmation of a position requires 1/2 majority in Council.
  9. Parties
    1. There are two classifications of parties. A party is considered "in-house" if it is restricted to members and their guests. Otherwise, the party is considered "out-of-house" (i.e. open to both members and non-members).
    2. All parties must follow the Bylaws. In particular, a party does not grant members or their guests the freedom to violate the Bylaws.
    3. Out-of-house parties have the following additional requirements:
      1. The party must be hosted by one and only one member (i.e., a Czar of Controlled Devolution). The "house" may not host the party.
      2. The member host must follow all USCA rules and guidelines for parties. *
      3. The member host must provide at least one week's notice of the party date to the membership.
      4. The member host must supply a $1000 deposit at least 48 hours before the party. The deposit must be used to repair any damage caused by the party (i.e. graffiti removal, broken windows, etc.).
      5. The house can pay any portion of the deposit by 2/3 majority Council vote.
      6. The party must be approved with 2/3 majority in Council.
  10. Room and Parking Assignments
    1. Organization
      1. The The Czar must notify all members the date and time of the first Room Bids of the next contract period prior to the end of the current contract period.
      2. The The Czar must post a list of all open rooms at least 12 hours in advance of the first Room Bids.
      3. The The Czar must notify the membership of Parking Bids or any mid-semester Room Bids at least 72 hours in advance.
      4. The The Czar must make every attempt to resolve as many room selection issues prior to the first Room Bids through pro-active investigation and cooperation with all residents.
      5. The The Czar has final authority for determining room and parking space assignments. Appeals may be made to the USCA Administrative Committee.
      6. During Fall and Spring, all private rooms are either singles, doubles or triples as defined by the USCA Planning Committee. During Summer, these distinctions are not made.
    2. Seniority Points
      1. A resident's seniority points are defined by USCA Administrative Code and are used to determine room and parking bid order.
      2. If a resident was a member the previous semester (this includes Spring if it is Fall) or has been a resident in the last 4 weeks, then all points earned in the USCA are active points. Otherwise, active points are all points earned as a member of CZ and inactive points are all other points earned in the USCA.
      3. Bidding points = active points + ( inactive points / 100 ).
      4. If two or three residents bid as a group, their bidding points are combined.
    3. Rights and Rules
      1. Temporary room assignments (e.g. week 0 assignments) are just that, temporary room assignments. Residents who occupy such rooms hold no rights to that room.
      2. Continuing residents may only "squat" a room from Fall to Spring, Spring to Summer, or Spring to Fall. Residents may not squat from Summer to Fall.
      3. During the Spring to Summer transition, two or more residents may not squat in the same room unless they rent-share.
      4. Continuing residents must provide notice of their intention to enter the bidding process to the The Czar at least 24 hours before Room Bids. Continuing residents that fail to do so will squat by default.
      5. Residents that bid lose all squatting rights.
      6. Residents of a partially open double or triple may "pull in" any other resident at any time. However, residents that do this lose all rights to bid on rooms for 4 weeks.
      7. Only one resident may bid on a single parking space.
      8. There are no squatting rights for parking spaces.
      9. Voluntary room or parking exchanges between residents may only occur with a 1/2 Majority Council vote.
      10. Rooms and parking spaces may only be used by the residents who were assigned to them. Subletting is strictly prohibited by USCA Administrative Code.
    4. Room Bid Procedure
      1. The The Czar must follow the Room Bid procedure outlined in the USCA The Czar handbook.
      2. Ties in bidding points are handled by random card drawings. Cards are ordered as follows: (first to last) A K Q J 10 9 8 7 6 5 4 3 2. Ties in card rank are broken by suit: (first to last) spades, hearts, diamonds, clubs.
      3. Before any room is selected, the The Czar must check to see if that selection would create a problem in satisfying any gender requirements. This is a difficult task which must be undertaken with the utmost care. The The Czar must block any room selection that creates such a problem.
    5. Parking Bid Procedure
      1. The order of Parking Bid selection is determined by bidding points. Ties are broken by random card drawings as described in the Room Bid procedure.
  11. Traditions

    It is important to recognize that a large house's survival absolutely depends upon a healthy, active and well-informed community. These traditions are not frivolous or silly -- they are essential to developing and sustaining such a community.

    1. CZ Disorientations

      4. Members are credited 2 (1.5 during Summer) regular workshift hours per semester for their participation.
    2. C'zine
      1. The goal of the C'zine is to...
        • ...explain the culture, history and identity of CZ.
        • ...present the successes and mistakes of the past.
        • ...say all the things that the Bylaws can't say but should say.
        • ...entertain.
      2. The Titular Councilor archives and maintains the C'zine.
      3. Changes to the C'zine can be made by any member with 1/2 majority Council approval.
    3. Fornicating and Ubiquitously Cleaning Krackistan (FUCK)
      1. The goal of the FUCK party is to...
        • ...clean all the nooks and crannies that never get cleaned.
        • ...take care of all the loose ends that never take care of themselves. (i.e. replacing signs, fixing furniture, etc.)
        • ...combine the feel of a party with the lofty vision of a comfortable, spotless house.
      2. The Czar of Labour must organize the FUCK party between weeks 3 and 5. (During Fall and Spring, the party will correspond with the first deadline for completion of HI hours.) The Director of Expressive Dynamism, Czar of Hearth and Social Workers are responsible for assisting the Czar of Labour in this task.
      3. Members will need to be reminded not to create new messes during the party.
      4. Members are assigned HI hours by the Director of Expressive Dynamism for their participation.
  12. Elected Positions
    1. Elected positions exist to serve the membership. **
    2. Members have the right to recall any member with an elected position by obtaining a petition of 20% of all members.
    3. Jointly-held positions are to be treated as a single position. Members with jointly-held positions are responsible for the negligence of their partners. If a member resigns from a jointly-held position, his/her partner must resign.
    4. Members who receive rent compensation are expected to average at least 17 hours of work per week. Members who receive 1/2 rent compensation are expected to average at least 11 hours of work per week. Members who otherwise hold elected positions are expected to average at least 5 hours of work per week.
    5. Assistant and crew positions are not elected positions. Unless otherwise noted, they are regular workshift positions rated at the compulsory weekly workshift requirement. Assistants and crew members must provide written evidence (i.e. time card) of their work to the Czar of Labour in order to receive workshift credit.
    6. Members who supervise assistants and crew members must assign them enough duties to meet their workshift requirement. However, assistants and crew members are ultimately responsible for completing their workshift requirements, regardless of the delinquency of their respective supervisor.
    7. Members with elected positions must attend all relevant Central Level meetings and follow any Central Level job duties if they exist.

    1. Commissar
      1. The Commissar is the protector of Casa Zimbabwe and the leader against tyranny and corruption.

    2. The Czar

      3. The The Czar can assign up to 40 workshift hours (20 during Summer) in the course of the semester for job assistance. This privilege is not available if the position is jointly-held.
      4. In general, the The Czar is responsible for the overall welfare and function of the house. S/he is to ensure that all members are living comfortably and cooperatively with each other, to the best degree that this is possible.
